UNDERME respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond promptly to properly submitted notices of alleged copyright infringement. If you believe that your copyrighted work has been copied and is accessible on UNDERME without authorisation, you may submit a DMCA notice as outlined below.

Filing a DMCA Notice (Copyright Infringement Claim)

If you are a copyright owner or an authorised agent acting on behalf of one, and you believe that content available on UNDERME infringes upon your copyrighted work, you may submit a DMCA takedown request by providing our Designated Copyright Agent with the following information:

1. Your Contact Information:

  • Full legal name
  • Address
  • Phone number
  • Email address

2. Identification of the Copyrighted Work:

  • A description of the copyrighted work you claim has been infringed (e.g., a link to the original work or other supporting documentation).

3. Identification of the Infringing Material:

  • A description of the infringing content and its location on UNDERME (e.g., a direct URL to the listing or content in question).

4. A Statement of Good Faith:

  • A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.

5. A Statement of Accuracy and Authorisation:

  • A statement, under penalty of perjury, that the information provided in the notice is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.

6. A Physical or Electronic Signature:

  • Your signature or the signature of an authorised representative.

Counter-Notification (Responding to a DMCA Notice)

If you believe that the content you posted was removed in error, you may submit a counter-notification to our Designated DMCA Agent. The counter-notification must include the following:

1. Your Contact Information:

  • Full legal name
  • Address
  • Phone number
  • Email address

2. Identification of the Removed Content:

  • A description of the content that was removed and its location before removal.

3. A Statement of Good Faith:

  • A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.

4. A Consent to Jurisdiction:

  • A statement that you consent to the jurisdiction of the courts in your country and agree to accept service of process from the party that submitted the original DMCA notice.

5. A Physical or Electronic Signature:

  • Your signature or the signature of an authorised representative.

What Happens Next?

  • Upon receiving a valid DMCA takedown notice, UNDERME will review the claim and may remove or restrict access to the allegedly infringing content.
  • If we remove content due to a DMCA complaint, we will notify the user who posted it.
  • If a valid counter-notification is received, we may restore the removed content unless the original complainant initiates a legal action against the user within 10 business days.

Repeat Infringers Policy

UNDERME reserves the right to terminate user accounts that are subject to multiple DMCA complaints or are found to be repeat infringers.
